Defendants have appealed from an order granting plaintiffs motion for new trial after a jury returned a verdict in favor of defendants in an action by plaintiffs to recover damages for the death of their 9-year-old son who was run over and killed by a trailer attached to a truck belonging to F. O. and Katherine C. Johnson and driven by their employee, James L. Tull. The order of the court granting a new trial asserted that it was based upon the ground of "insufficiency of the evidence to justify the verdict, and that the verdict of the jury was contrary to the weight of the evidence."
